Interlibrary Loan and Copyright

Interlibrary Loan is a cooperative agreement among libraries that allows libraries to request and supply materials for their patrons. 

Copyright guidelines govern the types of copying requesting and supplying libraries participating in ILL agreements can do. When submitting a request for a copy of an article, book chapter, etc., please check the box under the Notice - Warning Concerning Copyright Restrictions on the Interlibrary Loan Article/Book Chapter Request Form to acknowledge that you read, understand, and agree to comply with the copyright statement. See the example below.  The copyright notice box must be checked before your request can be processed.

 

 

Asa H. Gordon Library Interlibrary Loan office adheres to Section 108 of the Copyright Law (Title 17, United States Code), including CONTU (National Commission on New Technological Uses of Copyright) Guidelines regarding the 1976 Copyright Law (Title 17, United States Code). These guidelines impose annual limits on photocopy requests.

The requestor is aware that the requested photocopy or reproduction obtained via ILL is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, and later uses, a photocopy or reproduction for any other purpose, that user may be liable for copyright infringement. 

***Because of copyright law, as it relates to ILL, we cannot place photocopies received via Interlibrary loan on course reserve.  

 

Notice - Warning Concerning Copright Restrictions

The Copyright Law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.  Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.

This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.
